Accepting resignation during grievance process
Use this letter when an employee resigns while there is an ongoing grievance process which has resulted from a grievance that they have raised.
Should you continue to look at the grievance?
It is prudent to continue any grievance process started before the employee gave notice, unless and until they decide to withdraw the grievance. It is also a good idea to check why the employee has decided to leave as this may uncover issues which could be a breach of mutual trust and confidence or other breach of contract, and provide you with an opportunity to remedy the breach or avert a major dispute. An employee's failure to pursue a grievance is also not a bar to tribunal proceedings were they to wish to make a claim against you, although it may have an impact on the amount of any award which is made.
